Terms of Service

1. What KFOS is

KFOS is software for running a business in Kenya. Shops and suppliers use it for point of sale with M-Pesa, KRA eTIMS receipts, stock, books and staff. Online sellers use it to sell on the KFOS marketplace without a till. Chamas use it for group savings. Customers use it to buy from KFOS shops and pay by M-Pesa or their KFOS wallet.

2. How KFOS makes money

• KFOS is free to start.
• We take a small commission from the seller on each marketplace order.
• Optional paid features and credit products show their fees before you use them.
• M-Pesa transaction charges are passed through at Safaricom's published rates.
• We do not sell your data or show third-party advertising.

3. Your account

• You must be 18 or older and give true details.
• Keep your password and one-time codes private. You are responsible for activity on your account, including by staff you add.
• Some features need identity verification, such as payouts, credit and higher limits.
• We may suspend an account that is used for fraud, breaks the law or breaks these terms.

4. Buying and selling

• Each shop or seller sells its own goods and is responsible for them: what it lists, its prices, delivery and returns. KFOS provides the platform and payment flow.
• The price, delivery fee and any promo discount are shown at checkout before you pay. The total you confirm is the total you are charged.
• Sellers must not list illegal, counterfeit or unsafe goods. Sellers must also meet their own tax duties, including eTIMS where it applies.
• Disputes about an order go to the seller first. If they cannot settle it, contact us and we will help.

5. Payments, wallets and credit

• Payments run through Safaricom M-Pesa and partner banks.
• Money held for customers is kept separate from our operating funds. Our proof of reserves page shows the balances.
• Buy now, pay later and other credit products have their own terms, which are shown before you accept them.

6. Messages

By giving us your phone number, you agree to receive service messages about your account and orders by SMS, email or WhatsApp. These include codes, receipts, order updates and reminders. We send marketing messages only if you opt in, and you can opt out at any time by replying STOP. See our Privacy Policy.

7. Acceptable use

Do not misuse KFOS. That means no attempts to break its security, no scraping, no spam, no impersonating others, and no using it for money laundering or any illegal purpose.

8. Liability

We work to keep KFOS available and accurate, but it is provided "as is". To the extent the law allows, Synapse Systems is not liable for indirect losses, or for goods sold by independent sellers. Nothing in these terms limits your rights under the Consumer Protection Act, 2012.

9. Law, changes and contact

These terms are governed by the laws of Kenya. We will post any changes here, and tell you about significant ones in advance.
